DMCA Copyright Policy

1. Introduction and Purpose

FriendRex is a social entertainment platform where users rank, share, and discuss movies and television shows. This DMCA Policy describes how we respond to copyright infringement notices in accordance with the Digital Millennium Copyright Act (DMCA), specifically 17 U.S.C. § 512 and its implementing regulations.

This agent has been registered with the U.S. Copyright Office in the DMCA Directory as required by 17 U.S.C. § 512(c)(2). We will acknowledge receipt of your notice within 2 business days.

3. Notification of Claimed Copyright Infringement

If you believe that content on FriendRex infringes your copyright, you may submit a written notice of claimed infringement. To be valid, your notice must include all of the following information as required by 17 U.S.C. § 512(c)(3):

• Your physical or electronic signature
• Identification of the copyrighted work you believe has been infringed
• Identification of the infringing material and its location on the platform
• Your contact information (name, address, telephone, email)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or law
• A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner

Processing Timeline: We will acknowledge receipt of your notice within 2 business days. Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing content within 3-5 business days.

4. Counter-Notification Procedures

If your content has been removed as a result of a DMCA notice, and you believe the removal was in error or that your use is authorized, you may submit a counter-notification. Your counter-notification must be submitted in writing and must include the following information as required by 17 U.S.C. § 512(g)(3):

• Your physical or electronic signature
• Identification of the content that was removed and the location where it previously appeared
• A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
• Your name, address, telephone number, and email address
• A statement that you consent to the jurisdiction of the federal district court in the district where you reside (or if outside the U.S., in which FriendRex may be found) and that you will accept service of process

Restoration Timeline: If we receive a valid counter-notification and no court action has been filed by the original claimant within 10 business days, we will restore the content within 10-14 business days.

5. Repeat Infringer Policy

Friend Rex LLC maintains a policy of terminating, in appropriate circumstances and in our sole discretion, the accounts of users who are repeat infringers. We enforce a three-strike policy:

Strikes expire 90 days after issuance if no additional infringements occur. Users terminated for repeated infringement are prohibited from creating new accounts.

6. Safe Harbor Framework

Friend Rex LLC operates under the safe harbor provisions of 17 U.S.C. § 512(c), which protects service providers from copyright infringement liability for user-generated content under specific conditions. We:

• Do not have actual knowledge of infringing activity
• Are not aware of facts or circumstances indicating infringing activity
• Do not receive financial benefit directly attributable to the infringing activity
• Respond expeditiously to valid DMCA notices
• Maintain and enforce a repeat infringer termination policy

Our platform monetizes features such as premium subscriptions and creator partnerships—not copyrighted content itself. We do not profit from infringing material.

7. Third-Party Content

FriendRex uses movie and television data provided by The Movie Database (TMDB) API in accordance with their terms of service. Users are solely responsible for ensuring that the content they upload, share, or post on FriendRex does not infringe third-party intellectual property rights.

While we recognize fair use as a legal doctrine, we do not adjudicate fair use claims. Users who believe their removal was a fair use error may submit a counter-notification as described in Section 4.

8. Misrepresentation and Liability

Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. False DMCA claims and counter-notifications may result in legal action by the affected party.

9. Non-DMCA Content Reporting

For content concerns that do not involve copyright infringement—such as hate speech, harassment, misinformation, or violations of our Community Guidelines—please use our general reporting tools available within the FriendRex app or contact our support team at support@friendrex.app.

10. Modifications to This Policy

Friend Rex LLC reserves the right to update this DMCA Policy at any time. Material changes will be communicated to users via email notification or in-app alert. Your continued use of FriendRex following notification of changes constitutes acceptance of the updated policy.
